Welcome to brizo-bph.us (the “Site”). The Site provides information that promotes and sells our products. We also provide educational information to better inform our readers and customers about urinary and prostate health issues that affect men aged 50 and above and about our line of products.

Agreement. 

This Terms of Use, hereinafter “the Agreement,” specifies the terms and conditions applicable to your access to and use of the Site. Included on the site are microsites and mobile websites that expressly adopt these Terms of Use (collectively, the “Site”). The Agreement may be modified at any time by Se-cure Pharmaceuticals Inc., upon posting of the modified Terms of Use. Any such modifications shall be effective immediately. Each use of the Site shall constitute and be deemed your unconditional acceptance of this Agreement.

By using the Site, you represent that you are of legal age (18 years and over) and of legal competence to enter into a binding agreement with Se-cure Pharmaceuticals, Inc., and you are not otherwise prohibited from using or receiving the Site pursuant to the laws of the jurisdiction from which you are accessing or using the Site. If you are not able to conform to the representations in the preceding sentence, you are prohibited from using the Site; however, any unauthorized use of the Site by you shall be subject to these Terms of Use until such unauthorized use has been terminated.

If you would like a printed copy of these Terms of Use, it is your responsibility to use the print function available to you by means of your personal technology resources.

 

1. Privacy

Se-cure Pharmaceuticals Inc., respects the privacy of our users. Please refer to our Privacy Policy that explains users’ rights and responsibilities with respect to information that is disclosed on this Site.

2. Your Account

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account information and password, and restricting access to your account. You agree to assume liability for all activities pertaining to the use of your account. You acknowledge that Se-cure Pharmaceuticals Inc., is not responsible for third-party access to your account resulting from theft or misappropriation, and Se-cure Pharmaceuticals Inc., reserves the right to refuse or cancel service, terminate accounts or remove or edit content at our sole discretion.

3. Non-Confidential Information

Subject to any applicable terms and conditions set forth in our Privacy Policy, any communication or other material that you send to us through the internet or post on the Site by electronic mail or otherwise, such as any questions, comments, suggestions or the like, is and will be deemed to be non-confidential, and Se-cure Pharmaceuticals Inc., shall have no obligation of any kind with respect to such information. Se-cure Pharmaceuticals Inc., shall be free to use any ideas, photos, concepts, know-how or techniques contained in such communication for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products.

4. Billing and payment

Terms of payment are within our sole discretion, and, unless otherwise agreed to by us, payment must be received by us prior to our acceptance of an order. Payment for the products ordered through the Sites may be made with a valid credit card or other payment method offered through the Sites. Orders are not binding upon us until accepted by us. We reserve the right to refuse and refund any order or part of any order placed on these Sites.

5. General Shipping policy

  • Free Ground Shipping on all retail orders over 3 products!

  • Orders placed will be processed the following business day.

  • Orders placed on Fridays will be processed the following Monday.

  • Business days are Monday-Friday, excluding scheduled fulfillment center closures.

  • We do not process, ship or deliver orders on Saturdays or Sundays.

  • You will receive an email notification once your order ships.

  • Please allow approximately 3-5 business days (Monday-Friday, excluding scheduled fulfillment center closures) for tracking information to update.
     

6. Couriers
We use different couriers for your comfort:​

  • UPS (United Parcel Service)

  • ​FedEx

  • USPS (United States Postal Service)

             

7. Addressing Errors 

We will charge you a $14 fee for shipments that are either re-routed after leaving our warehouse or are incorrectly addressed due to customer error. Shipping labels are generated directly from the shipping information you have entered. If you provide us an incorrect zip code or other addressing error, e.g. incorrect or missing apartment number, you will be charged the $14 fee since the shipping company will charge us a fee for this correction.

8. Ownership

The Site is, and the content contained therein shall continue to be, the property of Se-cure Pharmaceuticals Inc., and is protected by applicable copyright, patent, trademark and other proprietary rights. Any copying, redistribution, use or publication by you of any part of the Site, or the content contained therein, is prohibited, except as expressly permitted in the Agreement.

 

9. Trademarks and Intellectual Property

Brizo® is a trademark of Se-cure Pharmaceuticals Ltd., the manufacturer and the parent company of Se-cure Pharmaceuticals Inc. All other content on the Site are either trademarks, service marks, domain names, logos, company names or indicia of origin, or are otherwise the property of Se-cure Pharmaceuticals Ltd., or its affiliates or licensors. You may not use any trademark, service mark, domain name, logo, company name, trade name or indicia of origin of Se-cure Pharmaceuticals Ltd., without permission from Se-cure Pharmaceuticals Ltd. Under no circumstances will you acquire any ownership rights or other interest in the Site, or the content contained therein, by or through your use of the Site. All rights not expressly granted are reserved.

10. Site Use 

Se-cure Pharmaceuticals Inc., grants you a limited, revocable, nonexclusive license to use the Site solely for your own personal or shopping purposes only and not for republication, assignment, sublicense, sale, preparation of derivative works or other use. You agree not to copy the site, reverse, engineer or break into the site, or use materials, products or services in violation of any law. Any use of the Site, or the content or materials contained therein, other than as specifically authorized in the Agreement, without the prior written permission of Se-cure Pharmaceuticals Inc, is strictly prohibited and will terminate the license granted herein. Unless explicitly stated herein, nothing in the Agreement shall be construed as conferring to you, whether by implication or otherwise, any title or ownership of, or exclusive use rights to, any intellectual property or other right and any goodwill associated therewith. Se-cure Pharmaceuticals Inc., reserves the right, without notice and in its sole discretion, to terminate your license to use the Site at any time and to block or prevent your future access to, and use of, the Site.

11. Compliance with Laws

You agree to comply with all applicable federal and local laws regarding your use of our website at brizo-bph.us. You further warrant that information or content provided by you to Se-cure Pharmaceuticals Inc., is, to the best of your knowledge, truthful and accurate.

12. Indemnification 

You agree to indemnify, defend and hold Se-cure Pharmaceuticals Ltd., and Se-cure Pharmaceuticals Inc., and our partners, employees, independent contractors, agents and affiliates, harmless from any liability, loss, claim and expense, including attorney’s fees, related to: (a) your violation of this Agreement; (b) your use of the Site (c) your inability to use this Site; (d) your violation of any rights of another; (e) any content provided by you; or (f) your conduct in connection with the Site.

13. Disclaimer 

THE INFORMATION, CONTENT AND SERVICES ON BRIZO.US ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF BRIZO.US IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SE-CURE PHARMACEUTICALS INC., DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES AND ANY IMPLIED WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT AS TO THE SITE AND THE INFORMATION, CONTENT AND MATERIALS CONTAINED THEREIN. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. You agree that the laws of the state of New York, without regard to conflicts of laws provisions, will govern the Agreement and any dispute that may arise between you and Se-cure Pharmaceuticals Inc., or its affiliates. Any action or proceeding related to or arising out of any dispute between you and Se-cure Pharmaceuticals Inc., or its affiliates shall be brought and maintained exclusively in a court of competent jurisdiction in New York, New York.

16. Dispute

We will make every reasonable effort to informally resolve any complaints, disputes or disagreements that you may have with us. If those efforts fail, by using the Site you agree that any dispute or claim relating in any way to your use of any the Se-cure Pharmaceuticals Inc., Site will be resolved by binding arbitration, rather than in court.

If any provision of the Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

 

18. Typographical errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error, or error in pricing or product information received from our suppliers, Se-cure Pharmaceuticals Inc., shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, whether or not the order has been confirmed and your credit or debit card has been charged. If your credit or debit card has already been charged for the purchase, and your order is canceled, Se-cure Pharmaceuticals Inc., shall promptly issue a credit to your credit or debit card account in the amount of the charge.

19. Termination 

Se-cure Pharmaceuticals Inc., may terminate the Agreement or your access to the Site at any time, with or without prior notice to you, for any reason and at Se-Cure Pharmaceuticals Inc.’s sole discretion. Se-cure Pharmaceuticals Inc., may also block or prevent your future access to and use of the Site.
